The guy at the Sacramento EDD office said I should refile instead of appeal, and that was a $400 mistake
I went to the EDD office on Broadway in Sacramento back in March because my payments just stopped with no letter, no nothing. The guy at the window looked at my paperwork for maybe two minutes and said don't bother appealing, just refile the whole claim from scratch. So I did that, and it took five weeks to process, and then they denied the new claim anyway because it wasn't a new job loss. My friend who works at a legal aid clinic later told me I had 30 days to file the appeal and I missed it because of that advice. Now I'm out around $400 and I'm wondering if anyone has had luck calling the EDD main line or getting a hearing after the deadline passed.
My cousin went through something kind of the same at the Oakland office a couple years back, not with EDD but with a tenant thing where the clerk told her she didn't need to show up to the hearing date. She skipped it and lost by default, and the legal aid person later said the clerk never should've told her that. The thing is, those window folks aren't caseworkers or lawyers, they're just people trained to move the line along, so whatever they say is basically not official advice and it won't help you later. For what it's worth on the deadline thing, I've heard the appeals board can sometimes take a late appeal if you can show good cause, like you got bad info from the department itself, but you usually need it in writing or some proof of who told you what. That's the part that bites people, because a verbal "just refile" at the counter leaves you with nothing to point to. Might be worth calling the main line and asking specifically about a late appeal for good cause, but I'd have low hopes without something on paper.
